Terms of Service
These Terms govern use of theleisuremode.store and purchases from The Leisure Mode. They must be read with our Privacy Policy, Cookie Policy, Shipping Policy and Return and Refund Policy.
1. Seller and contact details
The website and online store are operated by Marana Baz, trading as The Leisure Mode, business correspondence address Parisa, 06500 Menton, France. Email: info@theleisuremode.com. Telephone: +33749508909. Further details appear in our Legal Notice.
2. Scope and mandatory consumer rights
These Terms apply to visitors and customers. Nothing in them excludes or limits a statutory consumer right, legal guarantee, product-safety obligation or liability that cannot lawfully be excluded. When mandatory law in your habitual country of residence gives you greater protection, that protection continues to apply.
3. Eligibility and acceptable use
You must have legal capacity to place an order or act with the authorisation of a legal guardian. You may not use the site for fraud, unlawful resale, infringement, malicious code, scraping that disrupts the service, or any activity that violates law or another person's rights.
4. Product information
We make reasonable efforts to show accurate product titles, photographs, colours, materials, measurements, size information, prices and availability. Screen settings and lighting can affect colour appearance, and measurements may have reasonable manufacturing tolerances. These variations do not remove your rights where goods are materially misdescribed or non-conforming.
Products may be sourced and fulfilled by third-party partners. We remain the seller responsible for the order and the consumer remedies described in our policies.
5. Orders and formation of the contract
Products selected in the cart are not reserved until the order is accepted. By submitting checkout, you make an offer to buy the listed goods at the displayed total. We acknowledge receipt electronically. The sales contract is formed when we expressly accept the order or dispatch the goods, whichever occurs first.
We may refuse or cancel an order where payment cannot be authorised, a product is unavailable, delivery is impossible or unlawful, the information supplied is incomplete, fraud is reasonably suspected, or an obvious price or product error occurred. If payment has been collected for a cancelled order, we refund the amount due to the original payment method.
6. Prices, taxes and charges
Prices are displayed in euros unless another currency is clearly shown. Before you submit the order, checkout displays the total payable to The Leisure Mode, including the product price, selected shipping and any tax or duty that we collect. Your bank may impose an independent currency-conversion or payment fee.
Depending on dispatch origin and destination, a customs authority or carrier may impose import VAT, customs duty or brokerage charges not collected by us. We do not describe charges as included unless checkout or the order confirmation expressly states that they were collected.
7. Payment
Available methods are those shown at checkout. Payments are processed through Shopify and the selected payment provider. You must provide accurate billing information and are responsible for safeguarding account credentials. We never request complete card details or one-time security codes through email or a contact form.
8. Shipping, delivery and risk
Destinations, charges, processing, estimates, tracking and delays are described in our Shipping Policy. Goods may arrive in separate parcels. For consumer orders, risk remains with us until the goods are physically received by you or your designated third person, except where applicable law provides otherwise.
9. Cancellation, withdrawal, returns and refunds
Pre-dispatch cancellation requests are handled under our Order Cancellation Policy. Eligible consumers may withdraw from an online goods purchase within 14 calendar days after delivery without giving a reason. The procedure, return costs, refund of standard delivery, exceptions and our voluntary 30-day extension are in the Return and Refund Policy.
10. Legal guarantee and non-conforming goods
EU consumers receive at least the minimum two-year legal guarantee for goods that are faulty or do not conform to the contract, subject to any longer national protection. Available remedies may include repair, replacement, price reduction or refund as required by applicable law. Commercial warranties, if offered, do not reduce the legal guarantee.
11. Customer accounts
You are responsible for accurate account information and for protecting login credentials. Notify us of suspected unauthorised use. We may suspend an account where reasonably necessary for security, fraud prevention or a material breach, subject to applicable law.
12. Reviews and user content
Content you submit must be genuine, lawful and based on your own experience. It must not infringe rights, impersonate another person, contain malware or disclose another person's private information without authority. You grant us a non-exclusive licence to display and adapt submitted content for operating and promoting the store. We may remove unlawful, fraudulent or misleading content.
13. Intellectual property
The site's branding, layout, text, graphics and other content are owned by or licensed to The Leisure Mode. Personal, non-commercial browsing and shopping are permitted. Reproduction or commercial exploitation requires permission unless law allows it.
14. Third-party services and links
Shopify, payment providers, fulfillment providers, carriers and other services may have their own terms and privacy notices. External links are provided for convenience and do not make us responsible for a third party's independent content or service. This does not affect our responsibility for the sales contract.
15. Privacy and cookies
Personal data is handled according to our Privacy Policy. Information about cookies and consent choices appears in our Cookie Policy.
16. Site availability and liability
We take reasonable steps to keep the site secure and available but do not promise uninterrupted access. To the fullest extent permitted by law, we are not liable for indirect loss that was not reasonably foreseeable when the contract was formed. Nothing limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any liability that law does not permit us to exclude.
17. Events outside reasonable control
We are not responsible for delay caused by an event genuinely outside our reasonable control, but we will take reasonable steps to reduce the effect, keep you informed and provide any remedy required by law. Payment obligations and mandatory delivery or refund rights remain subject to applicable law.
18. Complaints and dispute resolution
Send complaints through our Contact Us page. We will try to resolve them directly. You may also contact a competent consumer authority or use an applicable alternative dispute-resolution body where available or required. The former EU Online Dispute Resolution platform is not used because it has been discontinued.
19. Governing law
These Terms are governed by French law. This choice does not deprive a consumer of mandatory protections in the country of habitual residence. A consumer may bring proceedings before any court that has jurisdiction under applicable consumer law; these Terms do not force a consumer to litigate only in France.
20. Changes and severability
We may update these Terms for legal, operational or service changes. The version in effect when an order is placed governs that order unless law requires otherwise. If one provision is invalid, the remaining provisions continue to apply.
